1. Scope

These Terms of Service apply to all orders placed by customers in the United States through brashgoodsco.com (the "Store"), operated by Markus Maurer, Brash Goods Co., Albert-Schweitzer-Ring 2E, 82256 Fürstenfeldbruck, Germany ("we", "us", "our"). By placing an order, you agree to these Terms.

2. Orders

Product listings in the Store are an invitation to submit an order. Add the items you want to your cart, proceed to checkout, enter your details and confirm the order. You can review and correct your entries before submitting. A binding contract is formed once you complete checkout and we confirm your order by email. Please make sure your email address is correct and that our emails are not blocked by spam filters.

All products are printed on demand for your order. Please check size, color and design carefully before ordering.

3. Prices and payment

All prices are shown in US dollars (USD). Prices do not include sales tax; any applicable sales tax is calculated and shown at checkout. Shipping costs are shown at checkout and in our Shipping Policy.

The available payment methods are displayed at checkout. Payment is due when you place your order.

4. Shipping and delivery

We currently ship to addresses within the United States. Delivery details are set out in our Shipping Policy. Risk of loss passes to you upon delivery.

5. Returns

Returns and refunds are governed by our Refund Policy.

6. Defects and warranty

If an item arrives damaged, defective or misprinted, please contact us within 14 days of delivery with your order number and a photo of the issue. We will replace the item or issue a refund. Any warranties implied by applicable law remain unaffected.

7. Limitation of liability

To the extent permitted by law, our liability for any claim arising from an order is limited to the amount you paid for the affected products. This does not limit liability that cannot be limited under applicable law.

8. Intellectual property

All designs, images and texts in the Store are our property or used with permission and may not be copied or used without our prior written consent.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law does not deprive you of the protection of mandatory consumer protection laws of your state of residence.
